In the first one seems like it should be ¿Es usted el vendedor o es señor Martinez?
because your talking to him. So is first one correct If so Why?

In a phone conversation.... so maybe when you don't know or if you talking about yourself you use the article.... third person maybe but not as I really think of third person
so maybe I need to expand my idea of third person.... I have the third person in another room and you are talking ABOUT them

In the second person:

...and in every other person:
